AGREEMENT TO OUR LEGAL TERMS

We are Bold and Wonderful Designs, doing business as Bold & Wonderful Designs and/or Bold & Wonderful ("Company," "we," "us," "our"), a company registered in Canada at 1205-1050 Broadview Ave, Toronto, Ontario M4K 2S3. We operate the website http://www.boldandwonderfuldesigns.ca (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services"). These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Bold and Wonderful Designs, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We will provide you with prior notice of any scheduled changes to the Services you are using. The modified Legal Terms will become effective upon posting or notifying you by boldandwonderful@outlook.com, as stated in the email message. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms. The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services. We recommend that you print a copy of these Legal Terms for your records.

Section 1 - Acceptance of Terms & Use

1.1 Before using the Bold & Wonderful Designs website, including accessing any services or ordering any products, please carefully read and ensure you understand these Terms and Conditions. If you have any questions or require further clarification regarding these terms, please do not hesitate to reach out to us via the email address provided above.

1.2 Your use of the Bold & Wonderful Designs website indicates your unconditional agreement to accept and be bound by the Terms and Conditions in effect at the time of usage, irrespective of whether or not you choose to register with the website. We reserve the right to modify all or any part of these Terms and Conditions (including the products and services available on the website) at any time.

1.3 If you are a registered user of the Bold & Wonderful Designs website, we will notify you by email in the event of any changes to these Terms and Conditions. If you are not a registered user, please ensure to check the 'last updated' information at the top of these Terms and Conditions periodically to confirm if any changes have been made since your last review.

1.4 If you do not accept these Terms and Conditions, then you should withhold using the Bold & Wonderful Designs website. Please note that by continuing to use the website, you signify your acceptance of any modifications to these Terms and Conditions. Kindly understand that if you refuse to accept these Terms and Conditions, you will not be able to place orders for any products from the Bold & Wonderful Designs website.

Section 2 - Company Information

2.1 Bold & Wonderful Designs is small owned and operated small business registered in the province of Ontario, Canada. Throughout these Terms and Conditions, the terms "Bold & Wonderful," "we," "us," and "our" refer to Bold & Wonderful Designs.

Section 3 - Our Products

3.1 We offer a variety of personalized greeting cards and/or custom printed paper goods for sale or purchase on our website. Products include, standard greeting cards and also personalized items are made to order, and custom mini poster prints.

3.2 By placing an order through our website, you agree to provide accurate and complete information about yourself, including your mailing address, billing address (if different from mailing) and payment details.

3.3 We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, suspicion of fraudulent activity, or issues with suppliers providing materials. In the event of an order cancellation for any reason no compensation will be offered, but a full refund will be promptly issued to the customer at the earliest and fastest convenience.

3.4 Every effort has been made to accurately represent our products, including descriptions and imagery, on the website. However, we cannot guarantee that all product descriptions, images, and other information are entirely accurate, complete, or error-free. We hereby disclaim any liability for errors or inaccuracies in product information presented on the website.

Section 4 - Pricing and Method of Payment

4.1 All prices listed on our website are in CAD (Canadian Dollars) and are currently NOT taxed. All prices may be converted and displayed in your local currency for your convenience at any time.

4.2 We accept payment through various methods, including credit/debit cards and third-party payment processors (Apple Pay or Google Pay). By providing payment information, you represent and warrant that you have the legal right to use the payment method. We do not store any payment information. Payment processing is handled securely by Wix Payments, our third-party payment processor, in accordance with their own terms and policy which may apply.

4.3 We reserve the right to change prices for products listed on our website at any time without prior notice. We cannot honor any previous prices unless you have received a formal quotation from us, which is valid for 30 days from the date of issue.

4.4 Unless stated otherwise, discounts codes, rewards and promotions cannot be used in conjunction with each other.

4.6 Bold and Wonderful Designs is not responsible for any local import duties or taxes that may apply to international orders. It is the buyer's responsibility to cover these charges if it does apply. You may at any time refer to your own country's rules for the details regarding rates (if applies).

Section 5 - Orders

5.1 You must be at least 18 years old to use the Bold and Wonderful Designs website and place orders.

5.2 When placing an order on the website, you agree to provide a valid email address and real name for correspondence and delivery purposes.

5.3 Orders are placed on the website by pressing the "Checkout" button during the checkout process. By confirming your order, you are agreeing to purchase the product(s) you have selected, subject to these Terms and Conditions.

5.4 Upon confirming your order, we will process payment using your provided source of payment method.

5.5 After payment, we will send you an order confirmation email detailing your order and any other relevant information about your order.

5.6 Please ensure to check your spam/junk folders for any important emails directing you to complete your order or any additional steps required.

5.7 Our acceptance of your order will occur when we email you to accept it. At this point, a legally binding contract will be established between you (the buyer) and Bold and Wonderful Designs.

5.8 Bold and Wonderful Designs will provide an estimated delivery date for your order via email. However, we cannot be held liable for any delays that may occur with postal or delivery services. For more details regarding delivery and estimated times, please refer to our Shipping and Delivery page.

5.9 For personalized/custom products, If you want to change or cancel your order, then this must be done within our 24 hour window from purchase time by contacting us. If you cancel a personalized/custom order after 24hour window without product being shipped, only half of funds paid of the product will be refunded due to the nature of product low-resale value.

Section 6 - Personalization & Custom

6.1 When personalizing products on our website, you agree to provide accurate and appropriate content. Bold and Wonderful Designs reserves the right to refuse to print any content that we deem to be offensive, inappropriate, or in violation of our policies.

6.2 We may refuse service or cancel orders that contain content that is discriminatory, hateful, violent, sexually explicit, or otherwise deemed inappropriate at our discretion. In such cases, we will promptly notify the customer and provide a full refund if payment has already been made.

6.3 It is the responsibility of the customer to ensure that the content they provide for personalization complies with our guidelines.

6.4 It is the sole responsibility of the customer to carefully review their personalized details for accuracy, including spelling and grammar, before submitting order. Once the order has been placed by the customer, no changes can be made after 24 hours of purchase time, and Bold and Wonderful Designs cannot issue any refunds for errors or omissions.

6.5 At times, customers may purchase a design but provide excessive information or wording that cannot feasibly fit onto the design. In this case we may provide additional assistance where needed if possible.

6.6 The customer understands that any information provided to us for the creation of their designs will be stored and used as per our Privacy Policy.

6.7 It is your responsibility to ensure that all content in a personalized product is correct, including the spelling and irregular format. We cannot edit or cancel an order for a personalized product once it has been printed. Please double-check your order on-screen before confirming your purchase. For further information on changing or canceling an order, please refer to Section 5.

6.8 Content Rules: We do not permit personalized products to include any content or material that infringes anyone's copyright, trade mark rights, or any other rights, contravenes any applicable law, or is false, inaccurate, misleading, offensive, abusive, threatening, defamatory, or promotes discrimination, harassment, or unlawful acts.

Section 7 - Shipping & Delivery

Section 8 - Returns, Refunds & Exchanges

8.1 If your Product(s) arrives damaged or with printing flows, you may request a refund or replacement as outlined in clause b. below. Please note, refunds will not be issued if the Product(s) are in good condition but contain incorrect content due to customer error during ordering. Refer to Section 6 for further details on ordering personalized products.

8.2 To request a refund or replacement for printing faults or damage on your order, you must notify us within 7 days of receiving the Product(s). For this you must email boldandwonderful@outlook.com with your order number, along with clear details and a photo of the damaged goods. We will then assess your request and determine if you are eligible for a refund or replacement. Please note that we do not take responsibility for customer-generated mistakes, as stated in Section 6.4.

8.3 If you choose to receive a refund for faulty or damaged Product(s), we will refund you the total amount paid, including any delivery charges, within 30 days of receiving evidence of the Product(s)’ condition.

8.4 Opting for a replacement of your Product(s) due to faults or damage will be provided free of charge, and we will resend them to you at no additional cost.

8.5 Please be aware that we do not offer both a refund and a replacement for the same order.

8.6 For non-personalized items, if you choose to return the product, we will refund you the total amount paid, including any delivery charges, within 30 days of receiving the return.

8.7 All personalized product(s) are non-returnable and non-refundable.

Section 9 - Privacy Policy

9.1 We are committed to ensure that we protect your privacy. For more details please review our Privacy Policy to understand how we collect, use, and disclose your personal information.

Section 10 - Intellectual property and acceptable use

10.1 All content on the Bold and Wonderful Designs website, including text, images, graphics, logos, and product designs, is the exclusive property of Bold and Wonderful Designs or its licensors and is protected by copyright laws and other intellectual property rights.

10.2 You are prohibited from reproducing, modifying, distributing, or otherwise using any content from our website without obtaining prior written consent from Bold and Wonderful Designs.

10.3 Our status, as well as that of any identified creators, as the authors of material on the Bold and Wonderful Designs website, must always be acknowledged if you intend to use any part of the content for personal use.

10.4 You may only use the Bold and Wonderful Designs for lawful purposes and must not use it in a manner that infringes upon the rights of others or inhibits anyone else's enjoyment of the website.

10.5 Without our prior written consent, you must not copy, reproduce, crawl, frame, republish, download, print, post, distribute, re-post, broadcast, record, transmit, edit, communicate to the public, link to, deep-link into, or distribute in any way the web pages or materials on the Bold and Wonderful Designs website other than solely for your own personal use.

10.6 You are prohibited from using the Bold and Wonderful Designs website or any part of its content for commercial purposes without obtaining a license to do so from us or our licensors.

10.7 In the event of a breach of these terms, your right to use the Bold and Wonderful Designs website will cease immediately, and at our option, you must return or destroy any copies of the materials you have made.

IP Infringement Policy

We respect the intellectual property rights of others and expect our customers to do the same. If you believe that any of your intellectual property rights have been infringed by any product offered for sale on our website, please contact us and provide us with the following information:

Identification of the copyrighted work claimed to have been infringed.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to locate the material.
Your contact information, including your address, telephone number, and email address.
A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Upon receiving notice of an infringing product, we will investigate and take appropriate action, including liaising with the relevant creator to remove the infringing product from sale.

Section 11 - Limitation of liability

11.1 Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

11.2 We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

11.3 To the maximum extent permitted by law, Bold and Wonderful Designs accepts no liability for any of the following:

a. any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;

b. loss or corruption of any data, database or software;

c. any special, indirect or consequential loss or damage.

Section 12 - Governing Law

12.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

Section 13 - Changes to Terms and Conditions

13.1 We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website with date of change. Your continued use of Bold & Wonderful Designs website after any such changes constitutes your acceptance of the new Terms and Conditions.
